Overview

Welcome to LINEWORK. The terms "we", "us" and "our" refer to LINEWORK. LINEWORK operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). LINEWORK is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with the policies referenced in them (the "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services. Please read them carefully — they include important information about your legal rights. Nothing in these Terms takes away any right you have under the Consumer Protection Act 68 of 2008 ("CPA") or the Electronic Communications and Transactions Act 25 of 2002 ("ECT Act").

By visiting, interacting with or using our Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you should not use the Services.

1. Access and account

By agreeing to these Terms, you confirm that you are at least 18 years old, or that you use the Services under the supervision of a parent or guardian who consents to these Terms on your behalf.

To use the Services, including browsing or purchasing, you may be asked to provide certain information such as your email address, billing, payment and shipping details. You warrant that all information you provide is correct, current and complete, and that you have the right to provide it. You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell or assign your account to another person.

2. Our products

We make every effort to represent our products accurately. Note in particular: our product is a cosmetic powder sold in fourteen shades, and every screen renders colour differently — the shade you see on your device is a guide, not a laboratory match. That is exactly why our free 30-day wrong-shade swap exists — see the Refund Policy.

Product descriptions may change at any time without notice. We may discontinue any product or limit quantities on a case-by-case basis. Nothing in this section limits your right under section 55 of the CPA to receive goods of good quality, free of defects and reasonably suitable for their intended purpose.

3. Orders

When you place an order, you make an offer to purchase. Your order is accepted when we confirm it after receiving and processing payment. We may decline an order at our discretion — for example where stock, payment or delivery-address problems arise — and where we decline, change or cancel an order we will notify you using the contact details you provided and refund any amount already paid.

Returns, refunds and exchanges are governed by our Refund Policy. Nothing in this section limits your cooling-off right under section 44 of the ECT Act.

Purchases through this store are for personal or household use. For salon, barber or wholesale volumes, email Support@linework.co.za.

4. Prices and billing

Prices, discounts and promotions may change without notice. The price charged is the price displayed at the time you place your order, as set out in your order confirmation email. Displayed prices include any applicable taxes. Delivery is charged separately and shown before you pay: R90 countrywide, free on orders over R600.

Promotions may be governed by their own terms; where those conflict with these Terms, the promotion terms govern for that promotion.

You agree to provide current, complete and accurate purchase and payment information, and you warrant that you are authorised to use the payment method you provide and that charges you incur will be honoured.

5. Shipping and delivery

Delivery times are estimates and depend on couriers and events outside our control; they are not guaranteed. Risk in the goods passes to you on delivery to your address — until then, transit problems are ours to resolve, not yours: if a parcel is lost or arrives damaged, contact us and we will sort it out as set out in the Refund Policy and Shipping Policy.

6. Intellectual property

The Services — including trademarks, brands, text, images, graphics, video, audio and their design, selection and arrangement — are owned by LINEWORK, its affiliates or licensors and are protected by South African and international copyright, trademark and other intellectual property laws.

You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit material from the Services without our prior written consent. All rights not expressly granted are reserved.

LINEWORK's name, logo and slogans are our trademarks. Shopify's name, logo and product names are trademarks of Shopify. Other names and logos are the trademarks of their respective owners.

7. Optional tools

You may be given access to tools offered by third parties that we neither monitor nor control. Such tools are provided "as is" and "as available", without endorsement, and your use of them is at your own risk, subject to the relevant third party's terms. New features added to the Services are also subject to these Terms.

8. Third-party links

The Services may contain links to third-party websites. We are not responsible for their content or accuracy, and transactions on third-party sites are between you and that third party. Review their policies before transacting, and direct complaints about third-party products to the third party.

9. Relationship with Shopify

LINEWORK is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with LINEWORK. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and LINEWORK, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with LINEWORK.

10. Privacy

Personal information collected through the Services is handled under our Privacy Policy and, because the Services are hosted by Shopify, certain information is collected and processed by Shopify under its own privacy policy, including transfers to service providers in other countries. Our Privacy Policy is written to the Protection of Personal Information Act 4 of 2013 (POPIA).

11. Feedback and reviews

If you submit ideas, suggestions, reviews or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish and display that Feedback in any medium, including commercially. You warrant that you own or have rights to your Feedback, that you have disclosed any compensation or incentive received in connection with it, and that it complies with these Terms.

Feedback must not be unlawful, defamatory, obscene or infringing, must not contain malware, and must not misrepresent its origin — you may not use a false email address or pretend to be someone else. We may monitor, edit, decline or remove Feedback at our discretion, we are not obliged to keep it confidential or compensate you for it, and we take no responsibility for Feedback posted by you or any third party. Reviews we display are from real customers who agreed to their publication.

12. Errors, inaccuracies and omissions

Occasionally information in the Services may contain typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions, delivery charges, transit times or availability. We may correct such errors and update information at any time. Where a price was displayed in obvious, inadvertent error, we may decline or cancel the affected order to the extent section 23 of the CPA permits, and we will refund any amount you have paid; otherwise the displayed price stands.

13. Prohibited uses

You may use the Services for lawful purposes only. You may not use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any applicable national or provincial law or regulation; (c) to infringe our or others' intellectual property rights; (d) to harass, abuse, defame, intimidate or harm any person; (e) to transmit false or misleading information; (f) to send spam or other unsolicited promotional material; (g) to impersonate any person or entity; or (h) to engage in conduct that restricts anyone's use of the Services or exposes LINEWORK, Shopify or users to liability.

You further agree not to: (a) upload or transmit viruses or malicious code; (b) reproduce, copy, sell or exploit any portion of the Services; (c) collect or track others' personal information; (d) spam, phish, pharm or pretext the Services; (e) use any robot, spider, scraper, data-extraction tool or other automated means — including AI tools such as agentic AI — to access the Services except as permitted under Section 14; or (f) interfere with or circumvent security or access-control measures. We may suspend or terminate your access without notice if we determine you have violated these Terms.

14. Agents

14.1 This section applies if you use, allow, enable or cause the deployment of an Agent to access, use or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity, executable without direct supervision.

14.2 No Agent may access, use or interact with the Services unless it identifies itself at all times and complies with 14.4 below, and no Agent may do so where we have requested it refrain.

14.3 We may limit, including by technical measures, whether and how any Agent accesses the Services.

14.4 Agents must: (i) identify themselves in all HTTP/HTTPS requests by including "Agent/[agent name]" in the user-agent string; (ii) not conceal that access is by an Agent, including by mimicking human behaviour or completing or circumventing CAPTCHAs or similar measures; (iii) respond truthfully to any prompt determining whether interaction is human; and (iv) not circumvent measures intended to block, limit or control Agent access.

15. Termination

We may terminate this agreement or your access to the Services at our discretion at any time, and you remain liable for amounts due up to the date of termination. Sections which by their nature survive termination — including Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, Severability, Waiver & Entire Agreement, Assignment, Governing Law and Privacy — continue to apply.

16. Your statutory rights

Nothing in these Terms — including Sections 17 and 18 — excludes, limits or waives any right you have, or any liability we bear, under the CPA (including the implied warranty of quality in section 56 and liability for defective goods in section 61), the ECT Act, or any other law that cannot lawfully be excluded. Where anything in these Terms conflicts with those laws, the laws apply.

17. Disclaimer of warranties

Information presented through the Services is made available for general information purposes. We do not warrant its accuracy or completeness, and reliance on it is at your own risk.

EXCEPT AS EXPRESSLY STATED BY LINEWORK, AND EXCEPT TO THE EXTENT PROHIBITED BY SOUTH AFRICAN LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. THIS SECTION DOES NOT APPLY TO THE STATUTORY WARRANTIES AND RIGHTS DESCRIBED IN SECTION 16.

18. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AND SUBJECT ALWAYS TO SECTION 16, IN NO CASE SHALL LINEWORK, OUR PARTNERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS OR LOSS OF DATA, WHETHER BASED IN CONTRACT, DELICT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED THROUGH THEM, EVEN IF ADVISED OF THEIR POSSIBILITY.

19. Indemnification

You agree to indemnify, defend and hold harmless LINEWORK, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services. We will notify you of any indemnifiable claim; we may control the defence and settlement at your expense, but will not settle any claim requiring non-monetary obligations from you without your consent, not to be unreasonably withheld.

20. Severability

If any provision of these Terms is found unlawful, void or unenforceable, it shall be enforceable to the fullest extent permitted by law, the unenforceable portion severed, and the remaining provisions unaffected.

21. Waiver; entire agreement

Our failure to exercise or enforce any right or provision of these Terms is not a waiver of it. These Terms and the policies posted on this site constitute the entire agreement between you and us regarding the Services and supersede prior agreements and communications. Ambiguities shall not be construed against the drafting party.

22. Assignment

You may not transfer or assign these Terms or your rights and obligations under them without our prior written consent; any attempt to do so is void. We may assign these Terms and our rights and obligations without consent or notice to you.

23. Governing law

These Terms, and any separate agreements whereby we provide you Services, are governed by and construed in accordance with the laws of the Republic of South Africa, and you and LINEWORK consent to the jurisdiction of the South African courts. This does not limit your right to refer a dispute to the Consumer Goods and Services Ombud or the National Consumer Commission.

24. Headings

Headings are for convenience only and do not limit or affect these Terms.

25. Changes to these Terms

The current version of these Terms is always available on this page. We may update, change or replace any part of these Terms by posting updates to our website, and we will notify you of material changes as required by law, effective on the date stated in the notice. Your continued use of the Services after changes are posted constitutes acceptance of them.
